    General Duty Clause, 29 USC 654, section 5(a)(1) requires that employers protect their employees from recognized hazards. 

    “Each employer shall furnish to each of his employees’ employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.”

    Additionally, the coronavirus is listed as a serious health hazard and must be recorded as an occupational illness in 29 CFR 1904.5(b)(2). This means that if an employee contracts COVID-19 from another employee or through occupational exposure on a cleaning job you asked him to do, the illness is recordable on the OSHA log for that business. If it results in job restriction, days away or fatality, this is also required to be recorded. If an employer chooses to ignore or not record that incident the employer will be held responsible. If you have a cleaning company not certified or licensed in biohazard “virus” cleanup and have not done the due diligence to vet that company it is the employers’ responsibility. Insurance companies are demanding all employers find reputable cleaning companies certified in the biohazard cleanup of “viruses”. Ultimately the employer did what they could, to help stop the spread and protect their employees and by doing so protect themselves their company and their assets.

    There is a requirement 29 CFR 1904.5(b)(2). to contact OSHA to actually report infections or hospitalization if it is from Coronavirus. Now more than ever if there is an infection, an OSHA and insurance investigation would follow and could result in a fine if the company did not take the necessary measures “ Disinfection practices and record keeping.” to  curb the spread. A lawyer will not be far behind. Protect your assets by implementing the steps necessary to curb the spread.
